The Law Overview – NSW Smoke Alarm Requirements

Under Division 7A of Part 9 of the Environmental Planning and Assessment Regulation 2000, smoke alarms must be installed in all buildings in NSW where people sleep.

• Must meet Australian Standard AS 3786
• Mandatory since 1 May 2006
• Applies to homeowners, landlords, and commercial operators

While NSW law provides the minimum requirement, Fire & Rescue NSW recommends higher levels of protection, such as interconnected smoke alarms in all bedrooms, hallways, and living areas.
